1. Acknowledgment of Risk I, the undersigned participant, acknowledge that my participation in baseball and/or softball activities at “The Building” involves inherent risks, including but not limited to, physical injury, property damage, or other damages. I understand that these risks include, but are not limited to, those associated with the physical activity itself, the use of equipment, and any interactions with other participants or spectators.

2. Assumption of Risk I voluntarily assume all risks associated with my participation in activities at “The Building”, including but not limited to, risks of injury, death, or damage to property that may arise from participation, whether caused by my own actions, the actions of others, or the condition of the facility.

3. Release and Waiver of Liability  In consideration of being allowed to participate in activities at “The Building”, I, on behalf of myself, my heirs, executors, administrators, and assigns, do hereby release, discharge, and hold harmless “The Building”, its owners, officers, employees, agents, and volunteers from any and all claims, demands, actions, or causes of action arising out of or related to any injury, loss, or damage that I may suffer while participating in activities at “The Building”, whether caused by negligence or otherwise.

4. Indemnification I agree to indemnify and hold harmless “The Building” from any and all claims, demands, actions, or causes of action, including reasonable attorneys’ fees, arising from or related to any injury or damage I may cause or incur while participating in activities at “The Building”.

5. Medical Treatment I consent to emergency medical treatment in the event of an injury or illness and acknowledge that I am responsible for any medical expenses incurred as a result of such treatment.

6. Photography and Media Release I grant “The Building” permission to use any photographs, videos, or other media taken of me during my participation in activities at the facility for promotional or informational purposes.

7. Governing Law This Waiver and Release of Claims shall be governed by and construed in accordance with the laws of the State of Missouri.

8. Severability If any provision of this Waiver and Release of Claims is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. Acknowledgment of Understanding I acknowledge that I have read this Waiver and Release of Claims in its entirety and understand its contents. I am aware that by signing this document, I am waiving certain legal rights and agree to be bound by its terms.

10. Parental Consent and Liability Release

I, the undersigned parent or legal guardian of the minor participant named above, hereby consent to their participation in activities at “The Building”.  I acknowledge and understand that participation involves inherent risks, and I assume full responsibility for any injury or damage that may occur. I release, discharge, and hold harmless “The Building”, its officers, employees, and agents from any and all claims, demands, or causes of action related to the minor’s participation. I also agree to indemnify “The Building”  for any claims brought by or on behalf of the minor participant.
